The agreement between you and ToonedUp Gifts when you use our store.

Agreement
By using www.toonedupgifts.com or placing an order, you agree to these terms. If you do not agree, please do not use the site. These terms are between you and ToonedUp Gifts.
What we provide
We turn a photograph you supply into cartoon-style artwork using automated image generation, and print your chosen design on a physical product which is made to order and shipped to you.
The photograph you upload
By uploading a photograph you confirm that:
- You own it, or otherwise have the right to use it for this purpose.
- You have the permission of every identifiable person in it.
- It does not infringe anyone’s copyright, trademark or other rights.
- It does not contain unlawful, hateful, sexual or violent content, and does not depict a person in a way they have not agreed to.
You remain responsible for the photograph you provide. We may refuse or cancel any order, and delete any upload, that we believe breaches these terms, and we will refund you in full where we do.
About the artwork
Artwork is generated automatically and every result is different. Because of this:
- We cannot guarantee an exact likeness, or that a particular detail will be reproduced.
- The result may differ between styles and between attempts with the same photograph.
- Quality depends heavily on the photograph you supply. Clear, well-lit photographs give the best results.
You can see your artwork free of charge before you buy anything. Once you have seen it and chosen it, you are buying that specific artwork on that specific product.
Ownership
You keep all rights in the photograph you upload. You may use the artwork we create from it for your own personal, non-commercial purposes. We keep ownership of our styles, prompts, branding and the site itself.
We may show examples of artwork on our site or social media only where you have given us permission. We will never do so otherwise.
Orders and payment
Prices are shown in USD and include or exclude tax as stated at checkout. Payment is taken in full when you order. An order is accepted once we send you a confirmation email.
We may cancel an order and refund you if the item is unavailable, the price was listed incorrectly, or we cannot lawfully fulfil it.
Changes and cancellation
Every item is made to order, so there is a short window before production begins. Contact us as soon as possible at info@toonedupgifts.com and we will cancel or amend your order if it has not yet been sent for printing. Once it has, we cannot change it. See our Shipping & Returns page for what happens after that.
Our responsibility to you
We will provide our service with reasonable care and skill. We are responsible for loss you suffer that is a foreseeable result of us breaking these terms, but not for unforeseeable loss, or for business losses.
To the fullest extent the law allows, our total liability in connection with any order is limited to the amount you paid for that order. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Things outside our control
We are not liable for delays or failures caused by events beyond our reasonable control, including carrier delays, supplier or production issues, extreme weather, or disruption to the services we depend on.
